Terms and conditions

**Article 1 – Definitions**

The following definitions are used in these terms and conditions:

- **Cooling-Off Period**: the period within which the consumer can exercise their right of withdrawal.
- **Consumer**: the natural person who does not act in the course of a profession or business and enters into a distance agreement with the trader.
- **Day**: calendar day.
- **Long-Term Agreement**: a distance contract for a series of products and/or services, where the delivery and/or purchase obligations extend over a certain period.
- **Durable Medium**: any means that enables the consumer or trader to store information in a way that allows future access and unaltered reproduction.
- **Right of Withdrawal**: the option for the consumer to terminate the distance agreement within the cooling-off period.
- **Trader**: the natural or legal person who offers products and/or services to consumers remotely.
- **Distance Agreement**: an agreement concluded using one or more techniques for remote communication within the framework of a system organized by the trader for the remote sale of products and/or services, up to and including the conclusion of the agreement.
- **Remote Communication Technique**: means of concluding an agreement without the consumer and trader being physically present in the same place at the same time.
- **Terms and Conditions**: the general terms and conditions of the entrepreneur.

- Activity: Sale of products for the fashion industry through trading with external suppliers who deliver goods directly to customers.

**Article 3 – Applicability**

These General Terms and Conditions apply to every offer from the entrepreneur and to every distance agreement between the entrepreneur and the consumer, as well as to every order.

Before concluding the distance agreement, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate before concluding the distance agreement where the general terms and conditions can be reviewed and that they will be sent to the consumer free of charge upon request.

When specific product or service conditions apply in addition to these General Terms and Conditions, the provisions in the second and third paragraphs apply, and in the event of conflicting terms, the consumer may invoke the provision most favorable to them.

**Article 4 – The Offer**

If an offer has a limited validity period or is subject to conditions, this will be clearly stated in the offer.

The offer includes a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to allow the consumer to make a proper assessment of the offer. If the entrepreneur uses images, these are a true representation of the offered products and/or services. Obvious mistakes or errors in the offer do not bind the entrepreneur.

**Article 5 – The Agreement**

The agreement is concluded, subject to the provisions of paragraph 4, at the moment of acceptance by the consumer of the offer and compliance with the stipulated conditions.

**Article 6 – Right of Withdrawal**

When purchasing products, the consumer has the option to terminate the agreement without giving any reason within 14 days. This cooling-off period starts the day after the consumer or a representative designated by the consumer receives the product.

During the cooling-off period, the consumer will handle the product and packaging carefully.

**Article 7 – Costs in Case of Withdrawal**

If the consumer exercises their right of withdrawal, the costs of returning the product will be borne by them.

**Article 8 – Exclusion of the Right of Withdrawal**

The trader can exclude the consumer's right of withdrawal for certain products and services, such as:

- Products manufactured according to the consumer's specifications.
- Products that cannot be returned due to their nature.
- Hygienic products whose seals have been broken.

**Article 9 – The Price**

During the validity period mentioned in the offer, the prices of the offered products and/or services will not be increased, except for price changes due to changes in VAT rates.

**Article 10 – Conformity and Warranty**

The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications listed in the offer, the reasonable requirements of reliability and/or usability, and the legal provisions and/or government regulations in force on the date of the conclusion of the agreement.

**Article 11 – Delivery and Execution**

The delivery location is the address provided by the consumer to the entrepreneur.

Accepted orders will be carried out with due diligence within 30 days unless otherwise agreed. If delivery is delayed, the consumer will be notified within 30 days after the order is placed and has the right to terminate the agreement free of charge.

**Article 12 – Long-Term Transactions: Duration, Termination, and Renewal**

For an indefinite period, the consumer may terminate an agreement at any time, observing the agreed termination rules and a notice period of up to one month.

**Article 13 – Payment**

Unless otherwise agreed, the amounts due by the consumer must be paid within 7 working days after the start of the cooling-off period.

**Article 14 – Complaints Procedure**

Complaints about the execution of the agreement must be submitted to the entrepreneur within 7 days, fully and clearly described.

**Article 15 – Disputes**

Agreements between the entrepreneur and the consumer to which these General Terms and Conditions apply are exclusively governed by Dutch law, even if the consumer resides abroad.
